These Terms of Service (“Terms”) govern your use of www.theclearstead.com (the “Site”) and any related online services operated by Clearstead LLC (“Clearstead,” “we,” “us,” or “our”). By accessing the Site, requesting an estimate, or otherwise interacting with us through this website, you agree to these Terms. If you do not agree, please do not use the Site.

1. Description of Services

Clearstead is a Massachusetts-based residential exterior cleaning company offering window cleaning, soft-wash house washing, and hardscape (driveway, walkway, patio, deck) pressure washing services across Greater Boston. The Site provides information about these services and a means to request an estimate. Use of the Site does not by itself create a service contract.

2. Estimates and Service Agreements

Any pricing communicated through the Site, by email, or by phone is an estimate only and is non-binding until both parties sign a separate written service agreement (the “Residential Service Agreement”). Estimates are based on the information you provide and may change once we inspect the property. We reserve the right to decline service for any lawful reason.

The terms governing the actual performance of services — including scope, scheduling, payment terms, cancellation, damage liability, and warranties — are contained in the Residential Service Agreement, which supersedes anything on the Site for the engagement it covers.

All content on the Site — including text, photography, illustrations, the Clearstead name and logo, the “Clearstead Intelligence” brand, before-and-after images, and the underlying code and design — is the property of Clearstead LLC or its licensors and is protected by United States and international copyright, trademark, and trade-dress laws.

You may view and print pages from the Site for your personal, non-commercial use only. Any other reproduction, modification, distribution, public display, or commercial use requires our prior written permission.

5. Submissions and Reviews

If you submit feedback, photos, testimonials, or other content to Clearstead, you grant Clearstead a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, adapt, and publish that content in connection with our marketing and services. We will not publish identifying information (full name, address) without your consent.

These services have their own terms and privacy policies, which apply alongside ours. Clearstead is not responsible for the availability, content, or practices of any third-party service.

7. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. Clearstead makes no warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. Photos and before-and-after imagery on the Site are illustrative and do not guarantee specific results on your property; individual results vary based on surface condition, materials, and environmental factors.

8. Limitation of Liability

To the fullest extent permitted by Massachusetts law, Clearstead, its members, officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site, including but not limited to loss of data, loss of profits, or business interruption — even if advised of the possibility of such damages.

For any direct claim related to use of the Site, our maximum aggregate liability shall not exceed one hundred U.S. dollars ($100). This limitation does not apply to liability arising from gross negligence, willful misconduct, or claims that cannot be limited under applicable law.

Liability arising from the actual performance of cleaning services is governed by the Residential Service Agreement, not these Terms.

9. Indemnification

You agree to indemnify and hold harmless Clearstead and its members, officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

10. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Modifications

We may revise these Terms at any time. Changes take effect when posted to this page. We will update the “Last updated” date at the top to reflect any revisions. Continued use of the Site after changes constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Site or these Terms shall be resolved exclusively in the state or federal courts located in Middlesex County, Massachusetts, and you consent to the personal jurisdiction of those courts.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
